Aria מיועדת לשימוש מבוגרים (הורים ומטפלים) מגיל 18 ומעלה, לתיעוד ומעקב אחר מידע על תינוק/ת שבטיפולם. האפליקציה אינה מכוונת לילדים ואינה מיועדת לשימוש ילדים. המידע שאתם מזינים נוגע לילדכם, אך הוא מוזן על ידכם, בעל/ת החשבון הבוגר/ת, ואתם אחראים לו. איננו אוספים ביודעין מידע אישי ישירות מילדים כמשתמשי האפליקציה.
אנו אוספים רק את מה שהאפליקציה זקוקה לו כדי לפעול: • מידע חשבון: כתובת אימייל וסיסמה, שם התצוגה שלכם, ובבחירתכם אסימון התחברות מ-Apple או Google (איננו מקבלים את סיסמת הספק). • מידע על התינוק/ת ומשק הבית: שם, תאריך ושעת לידה, מין, פרטי גדילה (משקל, גובה, היקף ראש), תמונת תינוק/ת, שם המשפחה, קודי הזמנה וחברי המשפחה. • נתוני פעילות שאתם מזינים: האכלות, חיתולים, שינה, ויטמין, אמבטיה, טעימות וחשיפה למזון (כולל תגובות והערות אלרגיה), אירועים, תזכורות והערות. כל רישום שומר מי הזין אותו ומתי. • מידע על מנוי: ספק המנויים (RevenueCat) וחנות האפליקציות מעדכנים אותנו לגבי מצב המנוי. איננו שומרים את פרטי כרטיס האשראי. • משוב שאתם שולחים אלינו, לרבות כתובת אימייל שתבחרו לכלול. • נתוני אבחון וקריסה (Sentry), המוגדרים שלא לשלוח מידע אישי כברירת מחדל. • מידע הנשמר במכשירכם למצב לא-מקוון ולתזכורות, וכן הפעלת ההתחברות באחסון המאובטח המוצפן. איננו אוספים מיקום מדויק, איננו משתמשים במזהי פרסום, ואיננו עוקבים אחריכם באפליקציות או באתרים אחרים.
אנו משתמשים במידע כדי ליצור ולאבטח את חשבונכם ולאמת אתכם; לספק את השירות המרכזי, כולל אחסון הרישומים וסנכרונם בין מכשירי בני המשפחה בזמן אמת; להציג תזכורות והתראות שאתם מפעילים; לעבד ולשקף את מצב המנוי; להשיב למשוב ולתמיכה; לתחזק את האפליקציה, לאבחן קריסות ולשפר אמינות ואבטחה; ולעמוד בחובות חוקיות ולהגן על זכויותינו.
במקום שהדין החל מחייב בסיס חוקי, אנו מסתמכים על: קיום חוזה עמכם לצורך אספקת האפליקציה; הסכמתכם, למשל להרשאות מכשיר כגון התראות וגישה לתמונות, שניתן לחזור בה בכל עת בהגדרות המכשיר; האינטרסים הלגיטימיים שלנו, כגון שמירה על אבטחה, מניעת שימוש לרעה ושיפור אמינות; וחובה חוקית.
חלק מהנתונים שאתם מזינים (למשל האכלה, תגובות לאלרגנים והערות גדילה) עשויים להיות קשורים לבריאות ילדכם. אנו מתייחסים אליהם כרגישים ומשתמשים בהם רק כדי לספק את שירות המעקב לכם ולמשפחתכם. איננו משתמשים בהם לפרסום או לפרופיילינג ואיננו מוכרים אותם. אנו נעזרים במספר מצומצם של ספקים מהימנים, הפועלים לפי תנאיהם ומדיניות הפרטיות שלהם: • Supabase - אחסון בענן, אימות, מסד נתונים ואחסון קבצים (כולל תמונות התינוק/ת). • RevenueCat - ניהול מנויים. • Apple App Store / רכישות מתוך האפליקציה (ו-Google Play במקום שמוצע) - עיבוד תשלום וחיוב. • התחברות עם Apple ו-Google - רק אם תבחרו בהן, לצורך אימות. • Sentry - דיווח קריסות ושגיאות (אבחון טכני, ללא מידע אישי כברירת מחדל). • Expo / EAS - פלטפורמת בנייה ואספקת האפליקציה. משוב שתשלחו מועבר לבעלת האפליקציה בערוץ התראות פנימי כדי שתוכל לקרוא ולהשיב. איננו מוכרים את המידע האישי שלכם ואיננו משתפים אותו עם צדדים שלישיים לצורכי השיווק שלהם.
הנתונים שלכם נשמרים אצל ספקי הענן שלנו, שעשויים לעבד ולאחסן נתונים בשרתים הממוקמים מחוץ למדינתכם, לרבות מחוץ לישראל ולאזור הכלכלי האירופי. משמעות הדבר שהמידע שלכם עשוי לעבור בין-לאומית. במקום שמתרחשות העברות כאלה, אנו מסתמכים על אמצעי ההגנה של ספקינו להעברות בין-לאומיות.
אנו שומרים את חשבונכם ואת הנתונים שאתם מזינים כל עוד החשבון פעיל. כשתמחקו את חשבונכם, אנו מוחקים את חשבונכם ואת המידע האישי הקשור אליו. שימו לב: מכיוון ש-Aria תומכת בשיתוף משפחתי, פרופיל התינוק/ת והיסטוריית הפעילות המשותפת שייכים למשק הבית, ולכן רישומים משותפים שאחרים במשפחתכם ממשיכים להשתמש בהם עשויים להישאר זמינים לאותם חברים גם לאחר מחיקת חשבונכם. אם ברצונכם שכל נתוני משק הבית יוסרו, על כל החברים למחוק את הנתונים או את חשבונותיהם, או לפנות אלינו.
נתונים במשפחה משותפים בין חבריה. כשאתם מזמינים מטפל בעזרת קוד הזמנה והוא מצטרף, הוא יכול לצפות בנתונים המשותפים של תינוקות משפחתכם ולהוסיף להם, וכל רישום מציג מי יצר אותו. הגישה מוגבלת לחברי משפחתכם באמצעות כללי אבטחת מסד הנתונים. אתם שולטים במי שאתם מזמינים; תוכלו להסיר חבר או להחליף את קוד ההזמנה בכל עת. קודי ההזמנה מוגבלים בקצב ופגי תוקף. בחרו בקפידה את מי אתם מזמינים.
בהתאם למקום מגוריכם, ייתכן שיש לכם זכויות לגשת, לתקן, לייצא, להגביל או למחוק את המידע האישי שלכם, להתנגד לעיבוד מסוים ולחזור בכם מהסכמה. חלק מהזכויות ניתן לממש ישירות באפליקציה: צפייה ועריכה של הנתונים; מחיקה קבועה של החשבון והמידע האישי דרך ההגדרות (מחיקת חשבון), בכפוף להערת השיתוף המשפחתי; הפעלה או כיבוי של הרשאות מכשיר; וניהול או ביטול מנוי דרך חנות האפליקציות. ניתן גם לפנות אלינו בכתובת ariaio.support@gmail.com, לרבות לבקשת ייצוא נתונים.
אנו נוקטים אמצעים טכניים וארגוניים סבירים להגנה על המידע: העברת נתונים בחיבורים מוצפנים (HTTPS); כללי אבטחת מסד נתונים המבודדים את נתוני כל משפחה כך שרק חבריה יכולים לגשת אליהם; אחסון פרטי לתמונות התינוק/ת, המוגשות בקישורים חתומים קצרי-מועד; שמירת ההתחברות באחסון המאובטח המוצפן של המכשיר; והגבלת קצב ותפוגה לקודי ההזמנה. אף שיטה אינה מאובטחת לחלוטין ואיננו יכולים להבטיח אבטחה מוחלטת. אתם אחראים לשמור על סיסמתכם ומכשירכם מאובטחים.

איננו מוכרים את המידע האישי שלכם, ואיננו משתפים אותו לפרסום התנהגותי בין-הקשרי.

בהורדת האפליקציה, בהתקנתה, בגישה אליה או בשימוש בה, אתם מאשרים שקראתם והבנתם את התנאים ואת מדיניות הפרטיות ושאתם מסכימים להם. אם אינכם מסכימים, אין לעשות שימוש באפליקציה. עליכם להיות בני 18 לפחות (או בגיל הבגרות החוקי במקום מגוריכם) וכשירים משפטית להתקשר בהסכם מחייב.
Aria היא כלי מידע וארגון. היא עוזרת להורים ולמטפלים לתעד ולעקוב אחר השגרה של התינוק/ת ולהציג תוכן חינוכי כללי. Aria איננה: מכשור רפואי; מקור לייעוץ רפואי, תזונתי, פסיכולוגי או מקצועי אחר; כלי לאבחון, טיפול, ניטור, ריפוי או מניעה; תחליף לשיקול דעת של רופא/ה או איש/אשת מקצוע מוסמך/ת; או שירות למקרי חירום. במקרה חירום, או אם אתם מודאגים לגבי בריאות ילדכם, התקשרו מיד למספר החירום המקומי או פנו לאיש/אשת מקצוע רפואי מוסמך/ת. אין להסתמך על האפליקציה.
כל התוכן באפליקציה, לרבות כל מדריך טעימות, מידע על אלרגנים, הצעות להאכלה, מידע על שינה, הנחיות מנות, לוחות זמנים ותזכורות, הוא מידע כללי בלבד. הוא אינו מותאם לילדכם. מידע בנוגע לחשיפה למזון מוצק, לאלרגנים ולטעימות טומן בחובו סיכונים מובנים, ובהם סיכון לחנק ולתגובות אלרגיות שעלולות להיות חמורות או מסכנות חיים. האחריות הבלעדית להחליט מה, מתי וכיצד להאכיל את ילדכם, ולהשגיח עליו בכל עת, מוטלת עליכם. יש להתייעץ עם רופא/ת ילדים או איש/אשת מקצוע לפני חשיפה למזונות חדשים, במיוחד אלרגנים, ולפני כל החלטה בנוגע להאכלה, שינה, תוספי מזון או בריאות. תזכורות והתראות הן כלי נוחות בלבד ועלולות להתעכב או לא להישלח; אין להסתמך עליהן לעניין רגיש לזמן או הקשור לבריאות. כל הסתמכות על האפליקציה היא על אחריותכם המלאה בלבד.
אתם מסכימים: למסור מידע מדויק ולשמור על סודיות פרטי החשבון; להשתמש באפליקציה אך ורק למטרתה האישית והלא-מסחרית של מעקב אחר ילדכם או ילד/ה שבטיפולכם; לא להשתמש בה באופן בלתי חוקי או הפוגע בזכויות אחרים; לא לנסות לגשת לנתונים של חשבונות אחרים, לפרוץ את האבטחה, להנדס לאחור או להפריע לאפליקציה; ולא להעלות תוכן בלתי חוקי או מזיק. אתם אחראים לכל פעילות המתבצעת בחשבונכם.
האפליקציה מאפשרת להזמין מטפלים נוספים למשק הבית באמצעות קוד הזמנה. אם הזמנתם מישהו, האחריות לבחירת המוזמנים ולמה שהם רואים ועושים מוטלת עליכם. כל חברי המשפחה יכולים לצפות בנתונים המשותפים ולהוסיף להם. אתם מאשרים שיש לכם הסמכות לשתף מידע על ילדכם. איננו אחראים לאופן שבו חברים מוזמנים משתמשים בנתונים. תוכלו להסיר חבר או להחליף את קוד ההזמנה בכל עת. מכיוון שהנתונים משותפים, רישומים משותפים מסוימים עשויים להישאר זמינים ליתר חברי המשפחה גם לאחר מחיקת חשבונכם.
האפליקציה עשויה להציע מנויים בתשלום. הרכישות והחיוב מעובדים על ידי Apple דרך App Store (ובמקום שמוצע, על ידי Google דרך Google Play). איננו מקבלים או שומרים את פרטי כרטיס האשראי המלאים. מנויים מחויבים לחשבון חנות האפליקציות ומתחדשים אוטומטית עד לביטולם, אלא אם תכבו את החידוש האוטומטי לפחות 24 שעות לפני תום התקופה. הניהול והביטול מתבצעים דרך הגדרות חשבון חנות האפליקציות, ולא דרכנו. תקופת ניסיון חינם, אם מוצעת, הופכת אוטומטית למנוי בתשלום אלא אם תבטלו לפני סיומה. החזרים מטופלים על ידי חנות האפליקציות; איננו מספקים החזרים ישירות, ובמידה המרבית המותרת בדין דמי המנוי אינם ניתנים להחזר.
האפליקציה, תוכנה, העיצוב, הטקסט, הגרפיקה, הלוגו והתוכנה שבה הם בבעלות בעלת Aria או מעניקי הרישיון שלה ומוגנים בדין. אנו מעניקים לכם רישיון מוגבל, אישי, לא-בלעדי, לא-ניתן-להעברה וניתן-לביטול להשתמש באפליקציה למטרתה. הנתונים שאתם מזינים על ילדכם נותרים שלכם; אתם מעניקים לנו רק את הזכויות המוגבלות הנחוצות לאחסן, לעבד, לסנכרן ולספק לכם את השירות.
האפליקציה מסתמכת על שירותי צד שלישי (למשל אחסון בענן, ניהול מנויים, ספקי התחברות ודיווח קריסות) לצורך פעולתה. השימוש עשוי להיות כפוף גם לתנאים של ספקים אלה. איננו אחראים לשירותי צד שלישי, וזמינותם אינה בשליטתנו. הצדדים השלישיים מפורטים במדיניות הפרטיות.
האפליקציה מסופקת על בסיס "כמות שהוא" (AS IS) ו"כפי שזמין" (AS AVAILABLE), על כל פגמיה וללא אחריות מכל סוג, במידה המרבית המותרת בדין. איננו מתחייבים כי האפליקציה תפעל ללא הפרעה, במועד, באופן מאובטח או ללא שגיאות; כי תוכן כלשהו מדויק, שלם, אמין, עדכני או מתאים לילדכם; או כי פגמים יתוקנו. אנו מסתייגים במפורש מכל אחריות משתמעת, לרבות סחירות, התאמה למטרה מסוימת, בעלות ואי-הפרה.
במידה המרבית המותרת בדין: בשום מקרה לא יישאו Aria, בעליה או מי מטעמה באחריות לכל נזק עקיף, מקרי, מיוחד, תוצאתי, לדוגמה או עונשי, או לאובדן רווחים, נתונים או מוניטין, הנובעים מהשימוש באפליקציה או מאי-היכולת להשתמש בה. איננו אחראים לכל נזק, פגיעה, תוצאה בריאותית או אובדן הנובעים מהסתמכותכם על האפליקציה או תוכנה, לרבות מידע בנוגע להאכלה, טעימות, אלרגנים, שינה או תזמון, או מכל החלטה בנוגע לילדכם. איננו אחראים לכל אובדן או השחתה של נתונים. ככל שלא ניתן לשלול אחריות, אחריותנו הכוללת המצטברת לא תעלה על הגבוה מבין: (א) הסכום ששילמתם לנו עבור האפליקציה ב-12 החודשים שקדמו לאירוע, או (ב) 50 דולר ארה"ב (או שווה ערך).
במידה המרבית המותרת בדין, אתם מסכימים לשפות ולפצות את Aria ואת בעליה, ולהגן עליהם, מפני כל תביעה, חבות, נזק, אובדן והוצאה (לרבות שכר טרחת עורך דין סביר) הנובעים מ: השימוש שלכם באפליקציה או השימוש לרעה בה; הפרת התנאים על ידכם; הפרת זכויות של צד שלישי, לרבות מטפל שהזמנתם או אדם שהזנתם את מידעו; או כל החלטה שתנקטו בנוגע לילדכם.
אנו רשאים לשנות, להשעות או להפסיק כל חלק מהאפליקציה בכל עת, וכן לעדכן תנאים אלה מעת לעת. אם נבצע שינויים מהותיים, ננקוט צעדים סבירים ליידע אתכם, למשל בעדכון תאריך "עודכן לאחרונה" או בהודעה בתוך האפליקציה. המשך השימוש לאחר כניסת השינויים לתוקף מהווה הסכמה לתנאים המעודכנים.
אתם רשאים להפסיק את השימוש ולמחוק את חשבונכם בכל עת מתוך האפליקציה. אנו רשאים להשעות או לסיים את גישתכם אם תפרו תנאים אלה או אם נסבור באופן סביר שהדבר נחוץ להגן על האפליקציה, על משתמשים אחרים או על צדדים שלישיים. סעיפים שמטבעם אמורים לשרוד את הסיום (לרבות ההבהרות, הגבלת האחריות, השיפוי, הקניין הרוחני והדין החל) ימשיכו לחול.
על תנאים אלה יחול דין מדינת ישראל, ללא תלות בכללי ברירת הדין שלה. לבתי המשפט המוסמכים בישראל תהיה סמכות שיפוט ייחודית בכל מחלוקת הנובעת מתנאים אלה או מהאפליקציה, בכפוף לכל זכות מחייבת שעשויה להיות לכם כצרכנים במדינת מגוריכם.
אם ייקבע כי הוראה כלשהי אינה ניתנת לאכיפה, יתר ההוראות יישארו בתוקף, וההוראה תוגבל או תוחלף במידה המזערית הנדרשת. אי-אכיפת זכות אינה מהווה ויתור. תנאים אלה, יחד עם מדיניות הפרטיות, מהווים את מלוא ההסכם בינכם לבינינו בנוגע לאפליקציה.

This Privacy Policy explains what personal information Aria (the "App", "we", "us") collects, why, how we handle it, and the choices you have. It is separate from our Terms of Use. By using the App you agree to this Policy. The App is operated by the owner of Aria, based in Israel. For any privacy question, contact ariaio.support@gmail.com.
Aria is intended for use by adults (parents and caregivers) aged 18 or older to record and track information about a baby in their care. The App is not directed to children and is not intended to be used by children. The information you enter is about your child, but it is entered by you, the adult account holder, and you are responsible for it. We do not knowingly collect personal information directly from children as users of the App.
We collect only what the App needs to work: • Account: email address and password, your display name, and if you choose it a sign-in token from Apple or Google (we do not receive your provider password). • Baby and household details: name, date and time of birth, gender, growth details (weight, height, head circumference), a baby photo, your family name, invite codes and family members. • Activity data you enter: feedings, diapers, sleep, vitamin, bath, tastings and food exposure (including reactions and allergy notes), schedule events, reminders and notes. Each log records who entered it and when. • Subscription information: our subscription provider (RevenueCat) and the app store tell us your subscription status. We do not store your full payment-card details. • Feedback you send us, including any email address you choose to include. • Diagnostic and crash data (Sentry), configured not to send personal data by default. • Data stored on your device for offline use and reminders, and your login session in encrypted secure storage. We do not collect precise location, we do not use advertising identifiers, and we do not track you across other apps or websites.
We use the information to create, secure and manage your account and authenticate you; provide the core service, including storing your logs and syncing them across your family members' devices in real time; show reminders and notifications you enable; process and reflect your subscription status; respond to your feedback and support; keep the App working, diagnose crashes and improve reliability and security; and comply with legal obligations and protect our rights.
Where applicable law requires a legal basis, we rely on: performance of a contract with you to provide the App; your consent, for example for device permissions such as notifications and photo access, which you can withdraw at any time in your device settings; our legitimate interests, such as keeping the App secure, preventing abuse and improving reliability; and legal obligation.
Some data you enter (for example feeding, allergen reactions and growth notes) may relate to your child's health. We treat it as sensitive and use it only to provide the tracking service to you and your family. We do not use it for advertising or profiling, and we do not sell it. Aria is an informational and organizational tool only and does not provide medical, nutritional or professional advice.
We use a small number of trusted providers, each acting under its own terms and privacy policy: • Supabase - cloud hosting, authentication, database and file storage (including baby photos). • RevenueCat - subscription management. • Apple App Store / In-App Purchase (and Google Play where offered) - payment and billing. • Apple Sign in and Google Sign-In - only if you choose them, for authentication. • Sentry - crash and error reporting (technical diagnostics, no personal data by default). • Expo / EAS - the platform used to build and deliver the App. Feedback you submit is forwarded to the App owner through an internal notification channel so the owner can read and respond. We do not sell your personal information and do not share it with third parties for their own marketing.
Your data is stored with our cloud providers, which may process and store data on servers located outside your country, including outside Israel and the European Economic Area. This means your information may be transferred internationally. Where such transfers occur, we rely on our providers' safeguards for international transfers.
We keep your account and the data you enter for as long as your account is active. When you delete your account, we delete your account and the personal data tied to it. Please note: because Aria supports family sharing, a baby's profile and shared activity history belong to the household, so shared records that others in your family continue to use may remain available to those members even after you delete your own account. If you want all shared household data removed, all members should delete the data or their accounts, or contact us.
Data in a family is shared among its members. When you invite a caregiver with an invite code and they join, they can view and add the shared data for your family's babies, and each entry shows who made it. Access is limited to members of your family by database security rules. You control whom you invite; you can remove a member or rotate the invite code at any time. Invite codes are rate-limited and expire. Choose carefully whom you invite.
Depending on where you live, you may have rights to access, correct, export, restrict or delete your personal data, to object to certain processing and to withdraw consent. You can exercise several directly in the App: view and edit your data; permanently delete your account and its personal data from Settings (delete account), subject to the family-sharing note; turn device permissions on or off; and manage or cancel your subscription through your app store. You can also contact us at ariaio.support@gmail.com, including to request an export of your data.
We take reasonable technical and organizational measures to protect your information: data transmitted over encrypted (HTTPS) connections; database security rules that isolate each family's data so only its members can access it; private storage for baby photos, served through short-lived signed links; your login session stored in the device's encrypted secure storage; and rate-limiting and expiry on invite codes. No method is completely secure and we cannot guarantee absolute security. You are responsible for keeping your password and device secure.
Aria is an informational and organizational tool only. It is not a medical device and does not provide medical, nutritional or professional advice, diagnosis or treatment, and it is not for emergencies. Any content about feeding, tastings, allergens, sleep or scheduling is general information and is not a substitute for advice from a pediatrician or qualified professional. Always consult a professional about your child's health, and never disregard professional advice because of something in the App. See our Terms of Use for the full disclaimer and limitation of liability.
If we become aware of a personal-data breach that is likely to affect your rights, we will take reasonable steps to address it and will notify affected users and any authority where required by applicable law, within the timeframes the law requires.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

These Terms of Use ("Terms") govern your access to and use of the Aria app and any related services. Please read them carefully. Our collection and use of personal information is described in a separate document, the Aria Privacy Policy.
By downloading, installing, accessing or using the App, you confirm that you have read, understood and agree to these Terms and the Privacy Policy. If you do not agree, do not use the App. You must be at least 18 (or the age of legal majority where you live) and legally able to enter into a binding agreement.
Aria is an informational and organizational tool. It helps parents and caregivers record and track a baby's routine and may present general educational content. Aria is not: a medical device; a source of medical, nutritional, psychological or other professional advice; a tool for diagnosis, treatment, monitoring, cure or prevention; a substitute for the judgment of a physician or other qualified professional; or a service for emergencies. In an emergency, or if you are worried about your child's health, call your local emergency number or contact a qualified healthcare professional immediately. Do not rely on the App.
All content in the App, including any tastings guide, allergen information, feeding suggestions, sleep information, portion guidance, schedules and reminders, is general information only. It is not tailored to your child. Information about introducing solid foods, allergens and tastings carries inherent risks, including choking and allergic reactions that can be severe or life-threatening. You are solely responsible for deciding what, when and how to feed your child, and for supervising your child at all times. Always consult a pediatrician or qualified professional before introducing new foods, especially allergens, and before any decision about feeding, sleep, supplements or health. Reminders and notifications are convenience tools only and may be delayed or not delivered; do not rely on them for anything time-sensitive or health-related. Any reliance you place on the App is strictly at your own risk.
You agree to: provide accurate information and keep your credentials confidential; use the App only for its intended personal, non-commercial purpose of tracking your own child or a child in your care; not use it unlawfully or in a way that infringes others' rights; not attempt to access other accounts' data, breach security, reverse engineer or interfere with the App; and not upload unlawful or harmful content. You are responsible for all activity under your account.
The App lets you invite other caregivers to your household using an invite code. If you invite someone, you are responsible for choosing whom you invite and for what they can see and do. Everyone in a family can view and add the shared data. You confirm you have the authority to share information about your child. We are not responsible for how invited members use the data. You can remove a member or rotate the invite code at any time. Because data is shared, some shared records may remain available to the remaining members even after you delete your own account.
The App may offer paid subscriptions. Purchases and billing are processed by Apple through the App Store (and, where offered, by Google through Google Play). We do not receive or store your full payment-card details. Subscriptions are billed to your app-store account and renew automatically until you cancel, unless you turn off auto-renew at least 24 hours before the end of the period. You manage and cancel through your app-store account settings, not through us. Any free trial, if offered, converts automatically to a paid subscription unless you cancel before it ends. Refunds are handled by the app store; we do not provide refunds directly and, to the maximum extent permitted by law, subscription fees are non-refundable.
The App, its content, design, text, graphics, logos and software are owned by Aria's owner or its licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. The data you enter about your own child remains yours; you grant us only the limited rights needed to store, process, sync and provide the service to you.
The App relies on third-party services (for example cloud hosting, subscription management, sign-in providers and crash reporting) to operate. Your use may also be subject to those providers' terms. We are not responsible for third-party services, and their availability is outside our control. The third parties we use are listed in the Privacy Policy.
The App is provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, timely, secure or error-free; that any content is accurate, complete, reliable, current or suitable for your child; or that defects will be corrected. We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement.
To the maximum extent permitted by law: in no event will Aria, its owner or anyone acting on its behalf be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to your use of, or inability to use, the App. We are not liable for any harm, injury, health outcome or loss arising from your reliance on the App or its content, including information about feeding, tastings, allergens, sleep or scheduling, or from any decision you make regarding your child. We are not liable for any loss or corruption of data. To the extent liability cannot be excluded, our total aggregate liability will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the event, or (b) USD 50 (or its equivalent).
To the maximum extent permitted by law, you agree to indemnify, defend and hold harmless Aria and its owner from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with: your use or misuse of the App; your violation of these Terms; your violation of any third-party rights, including any caregiver you invite or any person whose information you enter; or any decision you take regarding your child.
We may change, suspend or discontinue any part of the App at any time, and may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by updating the "last updated" date or through an in-app notice. Your continued use after changes take effect constitutes acceptance of the updated Terms.
You may stop using the App and delete your account at any time from within the App. We may suspend or terminate your access if you breach these Terms or if we reasonably believe it is necessary to protect the App, other users or third parties. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, intellectual property and governing law) will survive.
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts located in Israel will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, subject to any mandatory rights you may have as a consumer in your country of residence.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect, and the provision will be limited or replaced to the minimum extent necessary. Our failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
